POSITION DETAILS

The City University of New York (CUNY), the nation's largest urban public university system, seeks a senior leader in the Office of the General Counsel (OGC) to provide in-house strategic legal counsel and representation to senior administration leading high-profile special projects and performing management functions for the office. It is an exciting time to join the dynamic leadership team of CUNY, which continues to carry out its historic mission of educating a diverse student body. The OGC is the CUNY's system-wide resource for legal advice and representation. OGC assists decision makers in advancing the University's educational mission by providing expert, relevant and timely legal advice, guidance and advocacy. OGC's services touch all operational areas of the University and its 25 campuses.

The University Deputy General Counsel reports to the General Counsel and Senior Vice Chancellor for Legal Affairs and works closely with the General Counsel to set strategic goals, manage and supervise the legal work within OGC, and oversee relationships with outside counsel. The Deputy General Counsel provides legal advice to the University staff and administration to navigate significant legal challenges, including complex litigation, complex transactional projects, and government investigations. The Deputy General Counsel also provides legal support to senior administrators at the campuses and performs the duties of the Senior Vice Chancellor and General Counsel as and when required; representing the Senior Vice Chancellor at meetings, or other bodies, as assigned.

The Deputy General Counsel is a key member of CUNY's leadership team who provides valuable advice, counsel, representation and support on a wide variety of legal and related issues to the Board of Trustees, the Chancellery, and the campuses, including pre-litigation and litigation counseling/management, governance, compliance, privacy and data privacy, human resources, executive compensation, employment law including academic and tenure issues, environmental health and safety law, commercial contracts and transactions, non-profit law, immigration, student affairs, internal and external investigations and audits, legislation and ethics. The Deputy General Counsel vigorously represents and defends the interests of the University and provides leadership and management for the Office of the General Counsel and provides advice on strategic decisions facing the University.

Key duties and responsibilities include the following:

??? Provides legal counsel and advice to University leadership on matters involving legal interpretation and decisions related to operations and policy questions;

??? Participates in the definition and development of institutional policies, strategies, and major initiatives;

??? Coordinates with regulatory agencies and advises University leadership in navigating a complex regulatory environment;

??? Collaborates with multiple areas of the University to address issues and concerns with legal implications raised by students, faculty, staff, and the community;

??? Analyzes complex legal issues and serves as a creative partner in problem solving;

??? Provides strategic input and operational oversight on administrative and management initiatives within the OGC;

??? Provides legal and policy analysis of issues and participates in developing and drafting policies;

??? Facilitates complex business transactions and strengthens best practices and good governance;

??? Facilitates training and education of the University community on legal issues;

??? Supervises attorneys and non-attorney staff and/or legal fellows;

??? Engages and manages outside counsel as needed to represent the University; and

??? Performs other related duties, as assigned.

Note:

Until further notice, this is a hybrid position, eligible to work remotely and work in the office.

Candidates will be required to provide proof of being fully vaccinated against COVID-19 upon commencing employment. Exemption (medical or religious) requests to this requirement will be considered in accordance with applicable law. Being fully vaccinated is defined for this purpose as being at least two weeks past their final dose of an authorized COVID-19 vaccine regimen. Final candidates must be fully vaccinated as of their first day of employment.

QUALIFICATIONS

This position is in CUNY's Executive Compensation Plan. All executive positions require a minimum of a Bachelor's degree and eight years' related experience.

Preferred Qualifications:

Notwithstanding the foregoing all applicants for this position must possess the following qualifications:

  • JD from an accredited law school;
  • Membership in good standing in the New York State Bar or eligibility to obtain the same immediately;
  • Ten to fifteen years of progressively responsible legal experience as a practicing attorney required.

??? Fifteen or more years of experience practicing law with significant experience providing guidance in navigating a complex regulatory environment in a public or private setting;

??? Significant demonstrated expertise with a broad array of legal issues relating to higher education, particularly in the public sector, including legal expertise in at least several of the following areas:

  • Civil litigation
  • Commercial transactions, including public-private partnerships, technology transfer, and licensing
  • FERPA, Title IX, FOIL, and other federal, state, and local laws regulating higher education institutions
  • Labor and employment law and relevant federal, state and local civil rights law
  • Constitutional law, including the First Amendment
  • Intellectual property, privacy, copyright, and fair use
  • Gifts, trusts, and estates
  • Board governance
  • Real estate law
  • Internal and external investigations

??? Exemplary judgment and ethical standards, analytical acumen, superior problem-solving skills, decisiveness and ability to deliver timely advice;

??? Exceptional verbal and written communication skills;

??? Strong organizational skills with the ability to establish plans, manage a large workload and multiple assignments, and meet deadlines in a fast-paced office; and

??? Track record of leading, managing, and mentoring staff; and ability to establish and maintain collegial and productive working relationships with diverse stakeholders, constituents, clients, and colleagues within a diverse environment.

COMPENSATION AND BENEFITS

The salary range is $180,000 - $206,000; commensurate with education and experience.
